In Greene County district court Richard Leo Fay, 64, of Churdan was granted a deferred judgment Aug. 4 after he pleaded guilty to a charge of theft- third degree, amended from theft- second degree. He must pay a $855 civil penalty, and he was placed on probation to the Iowa Department of Corrections for one year. He must also pay $500 restitution for his court-appointed attorney’s fees. Yvonne Marie Locke, 48, of Jefferson was granted a deferred judgment after she changed her plea to guilty to a charge of possession of marijuana. She was placed on probation to Boone/Greene County Probation for one year, and she must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. She must pay a $430 civil penalty and $140 court costs. A companion case in magistrate court in which Locke was charged with possession of drug paraphernalia was dismissed. A judgment for a $105 fine with a $15.75 surcharge was entered against Joshua Allen Springer, 36, of Grimes after he pleaded guilty to a charge of criminal mischief- fifth degree, amended from criminal mischief- fourth degree. He must pay victim restitution and $225.89 court costs. A charge of trespass causing injury or damage greater than $300 was dismissed. (Sentencing: McCarville)
Troy James Harbacheck, 63, of Moorland was granted a deferred judgment after he pleaded guilty to a charge of possession of marijuana, amended from possession or marijuana with intent to deliver. He was placed on probation to Boone/Greene County Probation for one year, and he must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. A judgment was entered for a $430 civil penalty. Harbacheck was also granted a deferred judgment on a charge of possession of methamphetamine. A judgment for a $430 civil penalty was entered on that charge as well. He must pay restitution not to exceed $600 for his court appointed attorney’s fees and $127 court costs. A charge of possession of drug paraphernalia in magistrate court was dismissed, with $60 court costs assessed to Harbacheck. (Sentencing: McCarville)
Jonathan David Law, 39, of Churdan was sentenced to one year in jail after he changed his plea to guilty to a charge of operating while intoxicated- second offense. All but 10 days of the jail term was suspended and he was placed on probation to Boone/Greene County Probation for two years. He has already undergone a substance abuse evaluation and must follow any treatment recommendations at his own expense. He must also complete a community college drinking driver’s school. Law was fined $1,875 with a $218.25 surcharge. Court costs were $100. (Sentencing: Honorable Hans Becker)
Jason William Sheldahl, 52, of Scranton was sentenced Aug. 4 to 180 days in jail with credit for time served after he changed his plea to guilty to a charge of criminal mischief- fourth degree. The rest of the jail sentence was suspended and he was placed on probation to Boone/Greene County Probation for one year. Sheldahl was fined $430 with a $64.50 surcharge; the fine and surcharge were suspended. A charge of trespass causing injury or damage greater than $300 was dismissed. Court costs were $100. Jeremy William Roper, 39, of Churdan was sentenced to one year in jail after he changed his plea to guilty to a charge of OWI- second offense. All but seven days of the jail time was suspended and he was placed on probation to Boone/Greene County for one year. He must complete a community college drinking drivers course and he may complete the Des Moines Area Community College 96-hour alcohol education program at his own expense. Roper must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He was fined $1,875 with a $281.25 surcharge. A charge of possession of a controlled substance was dismissed. Court costs were $100. Persons pleaded not guilty to charges as follows: Mychael Douglas Mueller, 34, of Fort Dodge, fraudulent practice- third degree and gambling- avoid setoff; and Jay D. Wenger, 35, of Beaver, driving while license barred, two separate cases. Trials were set for Oct. 31 in every case.
Cases were initiated in district court as follows: Joshua Joseph Ireland, 44, of Jefferson, domestic abuse assault impeding flow of blood/air; Ryan James Brown, 51, of Jefferson, driving while license barred and eluding, as well as a charge in magistrate court of interference with official acts; and Anthony Joseph Nunez, 55, of Jefferson, domestic abuse assault display or use weapon.
